بوقفة، بثينةحكار، آيةمامن، بسمةخليفي، وردةحشوف، لبنى2026-09-282026-09-282026-06http://dspace.univ-khenchela.dz:4000/handle/123456789/11424خلال هذه المذكرة، تم التركيز على دراسة آليات الإثبات في المادة الجزائية الجزائرية، من خلال ثلاثة محاور أساسية: المبادئ العامة للإثبات، مبدأ الاقتناع الشخصي للقاضي، وطرق الإثبات التقليدية والحديثة. وقد أظهر التحليل أن النظام الجزائي الجزائري يتسم بالمرونة والتوازن بين حرية القاضي في البحث عن الحقيقة وحماية حقوق المتهم وضمانات المحاكمة العادلة. في الفصل الأول، تم تناول مبادئ الإثبات العامة، حيث أظهرت الدراسة أن حرية الإثبات تمثل الركيزة الأساسية التي تسمح للقاضي بالاعتماد على جميع وسائل الإثبات المتاحة دون التقيد بقيمتها القانونية أو ترتيبها، مع مراعاة شروط مشروعية الأدلة وعرضها للنقاش العلني. كما تم التطرق إلى الاستثناءات القانونية التي تقيّد هذه الحرية، مثل ضرورة الحصول على إذن قضائي للتفتيش أو قوة بعض المحاضر الرسمية، الأمر الذي يعكس اهتمام التشريع الجزائري بضمان التوازن بين الوصول إلى الحقيقة وحماية الحقوق الأساسية للأفراد. أما الفصل الثاني، فقد ركز على مبدأ الاقتناع الشخصي للقاضي الجزائي، الذي يمثل امتدادًا طبيعيًا لحرية الإثبات، إذ يمنح القاضي سلطة تقديرية واسعة في تقييم الأدلة واستخلاص الحقيقة الواقعية. وأكد البحث أن هذه السلطة، رغم اتساع نطاقها، تخضع لضوابط صارمة أهمها: الرقابة القضائية للمحكمة العليا وإلزامية تسبيب الأحكام، لضمان عدم الانحراف في استعمالها والحفاظ على حقوق الدفاع ومبدأ المواجهة بين الخصوم. وقد تبين أن المشرع الجزائري تبنى هذا المبدأ لضمان قدرة القاضي على التعامل مع الوقائع المعقدة والمتشابكة، بما يحقق العدالة الجنائية دون الإخلال بالضوابط القانونية. وفي الفصل الثالث، تم دراسة طرق الإثبات التقليدية والحديثة، حيث يشمل التقليدية مثل: الاعتراف، الشهادة، الخبرة، القرائن والمحررات، والتي تظل الوسائل الأساسية في إثبات الجرائم، مع تحديد شروط وقيمة كل منها في عملية الإثبات. كما تم تناول طرق الإثبات الحديثة، مثل البصمة الوراثية، البصمات الجنائية، التسجيلات الصوتية والمرئية، والأدلة الرقمية، التي أصبحت ضرورة ملحة في مواجهة الجرائم الإلكترونية والتقنية، وتعكس التطور المستمر في أدوات الإثبات لضمان دقة النتائج القضائية. بناءً على ما سبق، يمكن استنتاج أن النظام الجزائي الجزائري يعتمد على مزيج متوازن بين الحرية التقديرية للقاضي وضمانات قانونية صارمة، ما يسمح بتكوين حكم قضائي عادل قائم على الحقيقة الواقعية، مع حماية حقوق الأطراف المعنية. كما يُظهر البحث أهمية التكامل بين المبادئ العامة للإثبات، مبدأ الاقتناع الشخصي، وطرق الإثبات الحديثة في تكوين قناعة القاضي، وتعزيز فعالية القضاء الجزائي في مواجهة الجرائم التقليدية والحديثة على حد سواء. وفي الختام، يمكن التأكيد على أن فعالية نظام الإثبات في المادة الجزائية الجزائرية تعتمد على الموازنة الدقيقة بين الحرية القضائية والضوابط القانونية، بما يضمن الوصول إلى العدالة الجنائية دون الإخلال بحقوق الأفراد، ويُعد هذا التوجه نموذجيًا في الجمع بين التقاليد القانونية واحترام مبادئ حقوق الإنسان ومتطلبات العصر الرقميThis dissertation focuses on the study of evidentiary mechanisms in Algerian criminal law, through three main axes: the general principles of evidence, the principle of the judge's personal conviction (intime conviction), and traditional and modern methods of proof. The analysis showed that the Algerian criminal justice system is characterized by flexibility and balance between the judge's freedom to search for the truth and the protection of the accused's rights and guarantees of a fair trial. In the first chapter, the general principles of evidence were addressed, where the study showed that freedom of proof represents the fundamental pillar that allows the judge to rely on all available means of evidence without being bound by their legal value or order, while taking into account the conditions of the legality of evidence and its submission to public debate. Reference was also made to the legal exceptions that restrict this freedom, such as the necessity of obtaining judicial authorization for searches, or the probative force of certain official reports, which reflects the Algerian legislature's concern with ensuring balance between access to the truth and the protection of individuals' fundamental rights. The second chapter, meanwhile, focused on the principle of the criminal judge's personal conviction, which represents a natural extension of freedom of proof, insofar as it grants the judge broad discretionary power in evaluating evidence and deducing factual truth. The research confirmed that this power, despite the breadth of its scope, is subject to strict controls, the most important of which are: judicial review by the Supreme Court and the mandatory requirement to justify rulings, in order to prevent misuse of this power and to preserve the rights of the defense as well as the adversarial principle between the parties. It became clear that the Algerian legislature adopted this principle to ensure the judge's ability to deal with complex and intertwined facts, in a way that achieves criminal justice without undermining legal controls. In the third chapter, traditional and modern methods of proof were studied. Traditional methods include: confession, testimony, expert opinion, presumptions, and written documents, which remain the fundamental means of establishing crimes, along with a determination of the conditions and value of each in the evidentiary process. Modern methods of proof were also addressed, such as genetic fingerprinting, forensic fingerprints, audio and video recordings, and digital evidence, which have become an urgent necessity in confronting electronic and technological crimes, and which reflect the continuous evolution of evidentiary tools to ensure the accuracy of judicial outcomes. Based on the foregoing, it can be concluded that the Algerian criminal justice system relies on a balance between the judge's discretionary power and strict legal guarantees, which allows for the formation of a fair judicial ruling based on factual truth, while protecting the rights of the parties concerned. The research also demonstrates the importance of integration between the general principles of evidence, the principle of personal conviction, and modern methods of proof in shaping the judge's conviction, as well as enhancing the effectiveness of criminal justice in confronting both traditional and modern crimes. In conclusion, it can be affirmed that the effectiveness of the evidentiary system in Algerian criminal law depends on a precise balance between judicial freedom and legal controls, ensuring access to criminal justice without infringing upon individuals' rights.
