صاولي عبد الحليم2025-06-232025-06-232024أطروحة لنيل شهادة دكتوراه الطور الثالث (ل.م.د) تخصص: قانون مدنيhttp://dspace.univ-khenchela.dz:4000/handle/123456789/9255إن نشاط الترقية العقارية هو مجموعة عمليات تعبئة الموارد العقارية والمالية وكذا إدارة العمليات التي تساهم في إنجاز المشاريع العقارية من طرف المرقي العقاري ، يمارس هذا الأخير نشاطه شكل مقنن، إذ تبنى المشرع صيغ بيع لعقارات في طور الإنجاز تتمثل في عقود الترقية العقارية حتى لو لم ينص عليها المشرع بهذه التسمية مباشرة وهي عقد البيع على التصاميم، عقد حفظ الحق. وباعتبار أن للمرقي العقاري مركز قانوني خاص يجمع فيه بين تلك المسؤوليات والضمانات المقررة على البائع العادي كضمان العيوب الخفية وضمان الاستحقاق وعدم التعرض، وبين تلك المقررة على مشيدي المباني والتي نظمت في عقود المقاولة كالضمان العشري وضمان حسن التنفيذ، بالإضافة الى إقرار مسؤوليات خاصة تقع على عاتقه هو وحده كضمان إدارة وتسيير الأملاك المشتركة وهذا كله بحثا على إقرار حماية أكثر للمقتني باعتباره الطرف الأضعف في عقود الترقية العقارية. Real estate development activity is a set of operations involving the mobilization of real estate and financial resources, as well as the management of operations that contribute to the completion of real estate projects by the real estate developer. The latter carries out its activity in a codified manner. Legislators have adopted formulas for the sale of properties under construction, represented by real estate development contracts, even if the legislator does not explicitly designate them by this term. These include the contract of sale based on designs and the contract of reservation of rights. Considering that the real estate developer has a special legal status, it combines the responsibilities and guarantees imposed on the ordinary seller, such as the guarantee against hidden defects, the guarantee of entitlement, and the guarantee of non-interference, with those imposed on building builders, which are regulated in contracting contracts, such as the ten-year guarantee and the guarantee of good performance. In addition, special responsibilities fall solely on the developer, such as ensuring the management and administration of jointly owned properties. All of this is aimed at providing greater protection for the buyer, as the weaker party in real estate development contracts.otherThesis
