Abstract
يُعدّ الاتجار بالبشر من أخطر الجرائم التي تمس كرامة الإنسان وحقوقه الأساسية، إذ يهدف إلى استغلال الأفراد لتحقيق مكاسب مادية أو غيرها، حتى بموافقتهم الظاهرة. وقد وسّع التشريع الجزائري، تماشيًا مع بروتوكول الأمم المتحدة، نطاق تعريفه ليشمل أشكالًا مختلفة من الاستغلال، مثل العمل القسري، والتسول، والعبودية، ونزع الأعضاء، والاستغلال الجنسي. تُلحق هذه الجريمة أضرارًا بدنية ونفسية بالغة بالضحايا، فضلًا عن عواقب اجتماعية وأمنية، مما يستدعي اتخاذ تدابير شاملة لمكافحتها. يُرسي القانون 23-04 إطارًا قانونيًا يُجرّم الاتجار، ويضمن حماية الضحايا، ويُشجّع دور مؤسسات الدولة والمجتمع المدني في الوقاية. كما يُسلّط الضوء على أهمية التعاون الدولي لمكافحة هذه الجريمة العابرة للحدود الوطنية.Human trafficking is one of the most serious crimes affecting human dignity and fundamental rights, as it aims to exploit individuals for material or other gains, even with their apparent consent. Algerian legislation, in line with the UN Protocol, has expanded the definition to include various forms of exploitation such as forced labor, begging, slavery, organ removal, and sexual exploitation.This crime causes severe physical and psychological harm to victims, as well as social and security consequences, prompting the need for comprehensive countermeasures. Law 23-04 establishes a legal framework criminalizing trafficking, ensuring victim protection, and encouraging the role of state institutions and civil society in prevention.It also highlights the importance of international cooperation to combat this transnational crime
