| dc.description.abstract | الاختصاص أو ولاية القضاء هو سلطة الحكم بمقتضى القانون في خصومة معينة، ويقابله عدم الاختصاص وهو فقدان هذه السلطة، واختصاص محكمة ما معناه نصيبها من المنازعات التي يجوز لها الفصل فيها. والوقف قد تقع فيه بعض المنازعات مما يستدعي الفصل فيها بمقتضى الاختصاص الذي يحكمها. كما أن الوقف يتطلب لإثباته بعض الطرق منها ما هو شرعي ومنها ما هو قانوني. وقد تطرقنا في هذا البحث للاختصاص القضائي في المنازعات القضائية وكيفية إثباته، معتمدين في ذلك على مجموعة مراجع ونصوص فقهية وقانونية، وكذا بعض المواقع الالكترونية. وعليه ووفقا لما سبق حاولنا جمع شتات هذا الموضوع في مقدمة وثلاثة مطالب. بدأنا بتعريف المفاهيم والمصطلحات المتعلقة بالبحث، وتناولنا في المطلب الأول الاختصاص القضائي في المنازعات الوقفية، وتطرقنا في المطلب الثاني لإثبات الوقف يالطرق الشرعية، وفي المطلب الثالث لإثبات الوقف يالطرق القانونية. وانتهينا في ختام البحث إلى مجموعة من النتائج، سائلين الله تعالى التوفيق والسداد. The endowment may involve some disputes, which require adjudication according to the jurisdiction that governs it. The endowment also requires proof of some methods, some of which are legal and some that are legal. We have tried in this research that the jurisdiction has jurisdiction in judicial disputes and how to prove it, relying in this on a set of references and jurisprudence and legal texts, as well as some websites. Accordingly, and according to the foregoing, we tried to collect diaspora on this topic in preliminary and two studies .In introducing the concepts related to the research, we introduced in the first topic the jurisdiction of the endowment disputes, and we discussed in the second topic to prove the endowment in Algerian legislation.At the end of the research, we ended up with a set of results, asking God Almighty to be successfu. | |
