| dc.description.abstract | تأتي هاته الدراسة لتسليط الضوء على طبيعة العلاقة التي تربط البلدية بسلطة الوصاية والتي تعرف إختلالات في موازين الِقوى خاصة في الجزائر وعليه يجب التطرق لواقع هذه العلاقة القائمة أساساً على " الوصاية الإدارية " و التي أبانت عن عدم نجاعتها كما أن الشدة في الممارسة تحتاج إلى عملية مراجعة ، لذا يجب إعطاء حلول ناجعة تتوافق و الغايات المطلوبة وكذا المستجدات الحاصلة في مقدمتها وجوب تكريس مبادئ تعمل على كفالة الأهداف المذكورة ومعالجة الإختلالات المسجلة في مقدمتها " مبدأ التفريع " الذي سيكون محل هاته الدراسة الموسومة بعنوان « تكريس مبدأ التفريع نحو مفهوم جديد لعلاقة البلدية بالسلطة الوصية». This study aims to shed light on the nature of the relationship between the municipality and the trusteeship authority, as it knowsimbalances in the balance of power, especially in Algeria. Therefore, the reality of this relationship, which is mainly based on administrative trusteeship , must be addressed, as well as the reasons for its ineffectiveness ,as the intense practice requires a review process, so it would be necessary to provide effective solutions that are consistent with the desired goals and special developments, most importantly is the need to devote principles that work to ensure the effectiveness of the previously mentioned goals, and address the recorded imbalances, especially those related to the principle of branching that constitutes the subject of this study entitled “The consecration of principle of subsidiarity towards a new concept for the relationship between the municipality and the trusteeship authority ”. | |
