| dc.description.abstract | وتعتبر السياسة الجنائية الموجهة للمشرع هي التي تحدد الجرائم والعقوبات المقررة لها في ضوء الغرض الذي تستهدفه السياسة الجنائية. وهذه الصورة يمثلها قانون العقوبات والقوانين المكملة له. ال تحدد السياسة الموجهة للقضاء إجراءات التقاضي الجنائي، ومدى سلطة القاضي في توقيع العقوبات المقررة لها، ويتم تطبيقها عند رفع الدعوى الجنائية، وآخرها إصدار الحكم. حظيت الجريمة البيئية باهتمام كبير من المشرع الجزائري في سياسته الجنائية، حيث أصبحت الآن مشكلة خطيرة تهدد البيئة والإنسان على السواء. وقد سن المشرع العديد من النصوص من أجل الحد من ظاهرة الإضرار بالبيئة، مبينة من يتحمل المسؤولية الجنائية سواء كان شخصا طبيعيا أو معنويا، فضلا عن العقوبات الجنائية المقررة للجرائم البيئية.The criminal policy directed at the legislator is considered to be the one that defines the crimes and the sanctions prescribed for them in light of the purpose targeted by the Criminal Policy.This image is represented by the Penal Code and the laws supplementing it. the policy directed at the judiciary determines the procedures of criminal litigation, and the extent of the judge's authority in imposing the penalties prescribed for them, and is applied when criminal proceedings are initiated, the last of which is the issuance of a sentence. Environmental crime has received great attention from the Algerian legislature in its criminal policy, as it has now become a serious problem that threatens both the environment and man. The Legislature has enacted many texts in order to reduce the phenomenon of harming the environment, indicating who bears criminal responsibility, whether a natural or moral person, as well as the criminal penalties prescribed for environmental crimes. | |
