| dc.description.abstract | لقد خول المشرع الجزائري للنيابة العامة الحق في التدخل كطرف أصلي في جميع القضايا المتعلقة بشؤون الأسرة، بصريح نص المادة 03 مكرر من قانون الأسرة، وقد أثار تطبيق نص المادة عدة إشكالات وغموض من الناحية العملية، إلى حين صدور قانون رقم08/09 المتعلق بقانون الإجر ءات المدنية والإدارية المؤرخ في 25 فبراير 2008 الذي حاول من خلاله المشرع إزالة الغموض حول هذه المسألة،بأن حدد تدخل النيابة العامة بكل دقة في القضايا المدنية بصفة عامة، وفي القضايا المتعلقة بشؤون الأسرة بصفة خاصة، وفقا لنص المادة 256 التي خولت للنيابة العامة الحق في الإدعاء كطرف أصلي أو التدخل كطرف منظم.The Algerian legislator has granted the Public Prosecution the right to intervene as an original party in all cases related to family affairs, by the explicit text of Article 03 bis of the Family Code. The application of the text of the article has raised several problems and ambiguities in practice, until the issuance of Law No. 08/09 relating to the Code of Civil and Administrative Procedures dated February 25, 2008, through which the legislator tried to remove the ambiguity about this issue, by specifying the intervention of the Public Prosecution with precision in civil cases in general, and in cases related to family affairs in particular, according to the text of Article 256, which granted the Public Prosecution the right to claim as an original party or to intervene as an organizing party. | |
