| dc.description.abstract | جاءت دراستنا للتطرق إلى الرقابة الإدارية البيئية في التشريع الجزائري، وهي عبارة عن مجموعة من الإجراءات والقيود التي تفرضها الإدارة على الأشخاص بهدف الحفاظ على البيئة بما فيها من خصائص وتخضع لكافة مجالاتها، وقد منح المشرع للهيئات المركزية واللامركزية صلاحيات للتدخل في الرقابة وحماية البيئة وأعطاها وسائل وآليات قانونية لرقابة المسؤول البيئي، ومن ذلك ما يتضمنه من قوانين وضوابط بهدف التحكم في المخاطر البيئية التي قد يسببها الإنسان أو مصدر آخر وكيفية معالجتها، ونجد منها ما هو تنظيمي مسبق لمنع التلوث والحفاظ على جودة البيئة، ومنها ما هو رادع والذي يمثل عقوبات إدارية. Our study came to address the environmental administrative control in Algerian legislation, which is a set of procedures and restrictions imposed by the administration on individuals with the aim of preserving the environment, including its characteristics, and subject to all its fields. The legislator has granted central and decentralized bodies powers to intervene in control and environmental protection, and has given them legal means and mechanisms to control the environmental official, including what it includes of laws and controls with the aim of controlling environmental risks that may be caused by humans or another source and how to address them. We find some of them are prior regulatory to prevent pollution and preserve environmental quality, and some of them are deterrents that represent administrative penalties. | |
