| dc.description.abstract | تعد الوساطة الجنائية تعد آلية مبتكرة لتسوية النزاعات الجنائية خارج نطاق العدالة التقليدية، مما يُسهم في تخفيف العبء على النظام القضائي وتحقيق العدالة الجنائية بشكل أسرع وأكثر فعالية. يهدف تطبيق الوساطة الجنائية إلى توفير شرط إجرائي يُرضي الأطراف. فبالإضافة إلى الطبيعة الموضوعية للجريمة وإمكانية تسوية النزاع، تمر الوساطة أيضًا بعدة مراحل، تبدأ بالإجراءات الأولية كقبول الطلب، ثم مرحلة التفاوض بين الأطراف، وتنتهي بتنفيذ الاتفاق المتوصل إليه. ومع ذلك، تواجه الوساطة الجنائية بعض المعوقات، كعدم كفاءة الوسيط ومحدودية نطاق تطبيقه في بعض الحالات. ففي الجرائم، تُسهم الوساطة في نجاح الدعوى أو وقف الإجراءات القانونية، بينما في حالة عدم الطعن في الإجراءات التقليدية، تهدف الوساطة إلى تعزيز دور الوسيط وتوسيع نطاق تطبيق الضمانات لتحقيق فعالية أكبر في تحقيق العدالة الجنائية.Criminal mediation is an innovative mechanism for settling criminal disputes outside the scope of traditional justice, contributing to reducing the burden on the judicial system and achieving criminal justice more quickly and effectively. The application of criminal mediation aims to provide a procedural condition that satisfies both parties. In addition to the substantive nature of the crime and the possibility of settling the dispute, mediation also goes through several stages, beginning with initial procedures such as accepting the request, followed by negotiation between the parties, and ending with the implementation of the agreed-upon agreement. However, criminal mediation faces some obstacles, such as the incompetence of the mediator and the limited scope of its application in some cases. In crimes, mediation contributes to the success of the lawsuit or the suspension of legal proceedings, while in the absence of an appeal against traditional procedures, mediation aims to enhance the role of the mediator and expand the scope of application of guarantees to achieve greater effectiveness in achieving criminal justice. | |
