| dc.description.abstract | إن حق الطفل أو الحدث في الحماية هو حق تفرضه الطبيعة، وتحميه الفطرة، وتحميه جميع الشرائع السماوية، وحثت عليه المواثيق والاتفاقيات الدولية، وتنظمه القوانين. ولذلك سعت الكثير من التشريعات الإيجابية، بما في ذلك التشريع الجزائري، الذي أنشأ نظاما قانونيا جنائيا واسع النطاق من خلال مجموعة من النصوص القانونية. موضوعياً وإجرائياً، والتي تحدد سناً معينة، إذا لم يبلغها الطفل، يجب حينها حمايته إما كضحية أو كمجرم أو معرض للخطر. ولكن بعد دراسة أهم هذه النصوص يمكن القول إنها لا تتغلب بشكل كامل على جميع أنواع الرعاية التي يجب تقديمها للطفل، وليست كافية لتحقيق الهدف. وأخيرا، يجب على الجميع أن يجمعوا جهودهم بشكل فعال لتوفير الحماية اللازمة The right of a child or juvenile to protection is a right imposed by nature, protected by instinct, protected by all divine laws, urged by international charters and agreements, and regulated by laws.
