| dc.description.abstract | الخصوم والقاضي والمحامي، الأقطاب الأساسية الفاعلة في الدعوى القضائية بشقيها الجزائي والمدني، فإذا كان هدف الخصوم فيها الحصول على أكبر قدر ممكن من الفائدة، واتقاء أقل قدر ممكن من الخسارة، فإن هدف القاضي أساسا هو تطبيق القانون واقتضاء حق الدولة في العقاب، أما المحامي فيبقى سعه قائما على تحقيق العدالة، لأنه يمثل حلقة الوصل بين الخصوم والقاضي وحسن تطبيق القانون، فالمحامي كالمجتهد في الفقه الإسلامي، يسعى باجتهاده لإرشاد القاضي والدفاع عن حقوق الخصوم وحمايتها من الانتهاك مهما كانت طبيعة الدعوى القضائية، لذلك فإن استقلاليته نصا وتطبيقا تكون أكثر أهمية من استقلالية القاضي، لارتباطها بحقوق الخصوم من جهة، والنظام قانوني القائم على الحرية والعدالة من جهة ثانية. الكلمات المفتاحية : الاستقلالية ; المحاماة; الحصانة; المرافعة ; الدفوع.
