Abstract
الحماية القانونية للموظف في التشريع الجزائري يعد من الآليات الساسية التي يعتمدها المشرع
ضمان استقرار الوظيفة العمومية وصون كرامة الموظف وقد كرس القانون الأساسي العام للوظيفة العمومية الأمر03-06 جملة من الحقوق والضمانات التي تكفل حماية الموظف من التعسف الإداري وتوفر له سبل الدفاع عن نفسع في حال اتخاذ إجراءات تأديبية أو مساس بحقوقه، وتشمل هذه الحماية الجوانب الإدارية، التأديبية، الجزائية، والقضائية، بهدف خلق توازن بين سلطة الإدارة و حقوق الموظف وضمان أداء فعال وسير حسن للمرفق العامLegal protection for employees in Algerian law is one of the fundamental mechanisms adopted by the legislator.
Ensuring the stability of the civil service and preserving the dignity of employees. The General Basic Law for the Civil Service, Order 03-06, establishes a set of rights and guarantees that ensure the protection of employees from administrative abuse and provide them with the means to defend themselves in the event of disciplinary action or infringement of their rights. This protection includes administrative, disciplinary, penal, and judicial aspects, with the aim of creating a balance between administrative authority and employee rights, ensuring effective performance and smooth running of the public service.
