| dc.description.abstract | تتناول هذه الدراسة نظام إعادة التأهيل في التشريع الجزائري كآلية قانونية تهدف إلى إزالة آثار الإدانات الجنائية، ومنح المحكوم عليهم فرصة ثانية لاستعادة مكانتهم القانونية والاجتماعية بعد قضاء عقوبتهم وبقائهم سالمين من الجريمة لفترة محددة. وتُبرز الدراسة أهمية هذا النظام في دعم سياسات العدالة الجنائية الحديثة التي تُركز على الإصلاح وإعادة الإدماج بدلاً من مجرد العقاب. ينص كلٌّ من قانون الإجراءات الجزائية وقانون العقوبات الجزائريين على إعادة التأهيل بشكل صريح، مما يعكس التوجه الإنساني للقانون الجزائري. ومع ذلك، لا يزال تطبيقه العملي يواجه تحديات بسبب تعقيد الإجراءات وطول فترات الانتظار، مما يستدعي إصلاحًا فعالًا لتبسيط العملية وضمان العدالة الاجتماعية.This study addresses the rehabilitation system in Algerian legislation as a legal mechanism aimed at removing the consequences of criminal convictions and providing convicted individuals with a second chance to regain their legal and social standing after serving their sentence and remaining crime-free for a certain period. The study highlights the importance of this system in supporting modern criminal justice policies that focus on reform and reintegration rather than mere punishment. Rehabilitation is explicitly provided for in both the Algerian Code of Criminal Procedure and the Penal Code, reflecting the humanistic orientation of Algerian law. However, its practical implementation still faces challenges due to procedural complexity and long waiting periods, calling for an effective reform to simplify the process and ensure social justice. | |
