| dc.description.abstract | تهدف هذه الدراسة إلى تحليل دور الرقابة القضائية على عقود الصفقات العمومية كآلية فعالة لمكافحة الفساد المالي في الجزائر. وتُسلط الدراسة الضوء على أشكال الرقابة القضائية المختلفة، سواء تلك التي تسبق إبرام العقود العمومية أو التي تليها، مع بحث صلاحيات القاضي الإداري وحدودها في هذا المجال. تتناول الدراسة أولاً الرقابة القضائية السابقة لإبرام العقود العمومية، لا سيما من خلال إجراءات القضاء الاستعجالي والطعن في قرارات الإسناد المؤقت، وهي آليات وقائية تهدف إلى تلافي المخالفات قبل تشكّل العقد. وثانياً، تبحث الدراسة في الرقابة القضائية اللاحقة لإبرام العقد، وتحديداً عبر دعاوى القضاء الكامل، التي تمنح القاضي الإداري صلاحيات واسعة تشمل إلغاء العقد أو تعديله أو الحكم بالتعويض. وتخلص الدراسة إلى أن الرقابة القضائية تُعد أداة جوهرية في مكافحة الفساد المالي وحماية المال العام؛ غير أن فعاليتها تظل رهناً بالتطبيق السليم للنصوص القانونية وتعزيز استقلالية القضاء.This study aims to analyze the role of judicial oversight regarding public procurement contracts as an effective mechanism for combating financial corruption in Algeria. It highlights the various forms of judicial oversight—both pre-contractual and post-contractual—while examining the powers of the administrative judge and the limits thereof in this domain. The study first addresses pre-contractual judicial oversight, particularly through summary proceedings and challenges to provisional award decisions; these serve as preventive mechanisms designed to avert irregularities before the contract is finalized. Secondly, it examines post-contractual judicial oversight, specifically through "full jurisdiction" actions, which grant the administrative judge broad powers—including the authority to annul or modify the contract or to award compensation. The study concludes that judicial oversight is a vital tool for combating financial corruption and protecting public funds; however, its effectiveness remains contingent upon the proper application of legal provisions and the strengthening of judicial independence. | |
