Abstract
This study examines parental civil liability for the actions of minor children under Algerian legislation, focusing on balancing the protection of the injured party with the requirement for parents to fulfill their duties of supervision and upbringing. Parents are held liable for compensating damages resulting from their minor children's actions based on a presumption of fault regarding supervision and upbringing; however, they may rebut this liability by proving the existence of an external cause or by demonstrating that they properly exercised their supervisory duties.
The study also highlights the family's pivotal role in shaping minors' behavior and preventing delinquency, particularly in light of contemporary social and technological developments that have increased the likelihood of harm occurring through new forms and means. It concludes that, through this liability regime, Algerian legislation aims to ensure effective protection for victims while simultaneously encouraging parents to strengthen supervision and proper upbringing, thereby achieving a fair balance between individual interests and social stability.
