| dc.description.abstract | يتناول هذا البحث المؤسسات العقابية في التشريع الجزائري من خلال تحليل إطارها القانوني والتنظيمي وتطورها التشريعي، لا سيما في ظل القانون رقم 05-04، والتعديل الدستوري الأخير، وتعديل عام 2025 لقانون الإجراءات الجزائية. كما يستعرض البحث تصنيف هذه المؤسسات وأنظمة الحبس، مسلطاً الضوء على وظيفتها المزدوجة المتمثلة في تنفيذ العقوبات السالبة للحرية وتعزيز إعادة تأهيل النزلاء ودمجهم في المجتمع. وتُحلل الدراسة أيضاً أنظمة المعاملة داخل المؤسسات العقابية ومدى مراعاتها للضمانات الدستورية وحقوق الإنسان، فضلاً عن التأكيد على دور العقوبات البديلة في الحد من الاكتظاظ السجني وتعزيز فعالية العدالة الجنائية. وتخلص الدراسة إلى أن التشريع الجزائري يسعى إلى الموازنة بين الجانبين العقابي والإنساني للمؤسسات العقابية، رغم أن التطبيق العملي لا يزال يواجه تحديات تتعلق بالموارد وفعالية برامج إعادة التأهيل.This researchexamines correctional institutions in Algerian legislation by analyzing their legal and regulatory framework and their legislative development, particularly under Law 05-04 and the latest constitutional amendment,and the 2025 amendment to the Algerian Code of Criminal Procedure. It explores the classification of these institutions and detention systems, while highlighting their dual function of enforcing custodial sentences and promoting the rehabilitation and social reintegration of inmates. The study also analyzes treatment systems within correctional institutions and the extent to which they respect constitutional guarantees and human rights, in addition to emphasizing the role of alternative sanctions in reducing prison overcrowding and enhancing the effectiveness of criminal justice, It concludes that Algerian legislation seeks to balance the punitive and humanistic aspects of correctional institutions, although practical implementation still faces challenges related to resources and the effectiveness of rehabilitation programs | |
