| dc.description.abstract | يعتبر موضوع حماية البيئة من أهم وأعقد القضايا التي تهم الدولة، وذلك لأن الحفاظ على سلامتها يشكل جزءًا وثيق الصلة بعناصر النظام العام التي تظل الدولة ملزمة بالحفاظ عليها. والبيئة بحد ذاتها قيمة أساسية للمجتمع يجب حمايتها بكل الوسائل القانونية. وهي تضمن على وجه الخصوص الحماية الجنائية الشاملة والفعالة من خلال إرساء عدد من المبادئ والأسس التي تقوم عليها حماية البيئة. يعتبر التشريع الجزائري في القانون 10 - المادة 3، وعلى وجه الخصوص، 04، أن البيئة قيمة أساسية للمجتمع تتطلب الحماية وصياغة السياسة الوطنية لضمانها وحمايتها .والحفاظ عليها في إطار التنمية المستدامةThe issue of environmental protection is considered one of the most important and complex issues of concern to the state, because preserving its integrity is closely related to the elements of public order that the state remains obligated to preserve. The environment itself is a fundamental value for society that must be protected by all legal means.
