| dc.description.abstract | تعالج هذه الدراسة ظاهرة الإساءة في مسائل الأحوال الشخصية، مُركزًا على مفهوم "الحل التعسفي للرابطة الزوجية". ويستكشف حالات الإساءة في سياق إنهاء الزواج، ويُوضح موقف التشريع الجزائري من هذه المسألة، ويُدمج تفسيرات قضائية مُختلفة ذات صلة بنطاق البحث. وتبحث الدراسة في مظاهر الإساءة في فسخ الزواج، سواءً أكان ذلك من قِبل الزوج بممارسة الطلاق أو من قِبل الزوجة بحقها في الطلاق. كما يتناول العواقب القانونية، بما في ذلك التعويض، الناتجة عن هذه الممارسات التعسفية. وينقسم البحث إلى فصلين رئيسيين. يُرسي الفصل الأول إطارًا مفاهيميًا لفهم الإساءة في سياق فسخ الزواج. ينقسم هذا الفصل إلى قسمين: يُركز الأول على مفهوم الإساءة في ممارسة الحقوق القانونية، بينما يتناول الثاني أشكالاً محددة من الإساءة في حالة فسخ الزواج. أما الفصل الثاني، المعنون "مظاهر الإساءة في فسخ الرابطة الزوجية والتعويضات المرتبطة بها"، فيتألف من قسمين أيضاً. يُحلل القسم الأول أساليب الإساءة المتعلقة بحق الزوج في الطلاق وحق الزوجة في الطلاق، بينما يناقش القسم الثاني الآليات والمعايير القانونية لتعويض ضحايا هذه الإساءة. وتختتم الدراسة بخلاصة لنتائجها وتوصياتها الأولية. كما تُستكمل بقائمة شاملة من المصادر والمراجع وفهرس، مما يُوفر أساساً متيناً لمزيد من البحث العلمي.This study addresses the phenomenon of abuse in personal status matters, focusing on the concept of "arbitrary dissolution of the marital bond." It explores cases of abuse in the context of marital termination, clarifies the position of Algerian legislation on this issue, and integrates various judicial interpretations relevant to the scope of the research. The study examines the manifestations of abuse in marital dissolution, whether by the husband through divorce or by the wife through her right to divorce. It also addresses the legal consequences, including compensation, resulting from these abusive practices. The research is divided into two main chapters. The first chapter establishes a conceptual framework for understanding abuse in the context of marital dissolution. This chapter is divided into two parts: the first focuses on the concept of abuse in the exercise of legal rights, while the second addresses specific forms of abuse in the case of marital dissolution. The second chapter, entitled "Manifestations of Abuse in Marital Dissolution and Related Compensation," also consists of two parts. The first section analyzes the forms of abuse related to the husband's right to divorce and the wife's right to divorce, while the second section discusses the legal mechanisms and standards for compensation for victims of such abuse. The study concludes with a summary of its findings and preliminary recommendations. It is complemented by a comprehensive list of sources and references and an index, providing a solid foundation for further scholarly research. | |
