| dc.description.abstract | إن الهدف من هذه الدراسة هو الوقوف على دور التحكيم الالكتروني في تسوية منازعات التجارة الإلكترونية بوسائل الكترونية، بعيدا عن إجراءات التقاضي التقليدية وما تتسم به من تعقيدات، وهذا بالنظر للأهمية الكبيرة والمكانة التي أصبحت تحظى بها في الوقت الراهن باعتبارها طريقاً بديلاً يوفر العديد من المزايا كالسرعة والسرية والفاعلية، كمالا تكون عرضة للعقبات القانونية، يتم من خلالها حسم النزاع بإرادة الخصوم. التحكيم عبر الإنترنت ، أو ما يعرف بتسوية المنازعات عن بعد من خلال مراكز التحكيم ، فعال للغاية ومهم في حل النزاعات بطرق حديثة وحديثة لم يكن المتقاضون على دراية بها من قبل ، وكذلك رجال القانون ، حيث عبء مواجهة هذا المذهل يقع التطوير في ثورة الاتصالات على عاتقهم وفق القواعد القانونية المناسبة. ودعم التطور في مجال التحكيم عن بعد The purpose of This study is to identify the rôle of electronic arbitration in the settlement of E-Commerce disputes concluded by electronic means away from the traditionnel , litigation procedures and their complexities. This is in view of the great importance and position that the electronic mediation holds currently as an alternative way for providing many advantages such as: rapidity, confidentiality, effectiveness as well as not being asubject to legal obstacles. Through this process disputes are solved with the resolution of the adversaries. Arbitration via the Internet, or what is known as remote dispute resolution through arbitration centers, is highly effective and important in resolving disputes in modern, modern ways that litigants are not familiar with before, as well as lawmen, as the burden of facing this amazing development in the communications revolution falls on their shoulders in accordance with the appropriate legal rules.
