| dc.description.abstract | تعد ضمانة تحويل رؤوس الأموال المستثمرة إلى الخارج من أبرز عوامل جذب المستثمرين وتشجيعهم، مما جعل المشرع الجزائري في سبيل ترسيخ هذه الضمانة إلى سن من التشريعات الوطنية وابرام الاتفاقيات ما يحققها، غير أنه وفي سعي منه لحماية الاقتصاد الوطني من خلال الحفاظ على احتياطات الدولة من العملة الصعبة قيد هذه الضمانة بضوابط حتى يخلق توازنا بين مصلحة المستثمر في تحويل أمواله وضمان نمو الاقتصاد من خلال استقرار سعر الصرف والحفاظ على العملة الصعبة، ومن أبرز هذه الضوابط؛ ضابط العملة الحرة في التمويل والتحويل وأن يكون أصل رأس المال المستثمر من مصدر خارجي إلى جانب ضوابط شكلية يقتضيها غالبا التنظيم للسير الحسن للعملية.
