Abstract
تعد ضمانة تحويل رؤوس الأموال المستثمرة إلى الخارج من أبرز عوامل جذب المستثمرين وتشجيعهم، مما جعل المشرع الجزائري في سبيل ترسيخ هذه الضمانة إلى سن من التشريعات الوطنية وابرام الاتفاقيات ما يحققها، غير أنه وفي سعي منه لحماية الاقتصاد الوطني من خلال الحفاظ على احتياطات الدولة من العملة الصعبة قيد هذه الضمانة بضوابط حتى يخلق توازنا بين مصلحة المستثمر في تحويل أمواله وضمان نمو الاقتصاد من خلال استقرار سعر الصرف والحفاظ على العملة الصعبة، ومن أبرز هذه الضوابط؛ ضابط العملة الحرة في التمويل والتحويل وأن يكون أصل رأس المال المستثمر من مصدر خارجي إلى جانب ضوابط شكلية يقتضيها غالبا التنظيم للسير الحسن للعملية.
The guarantee of transferring the invested capitals abroad is one of the most important factors that attract and encourage investors, Which made the Algerian legislator, in order to consolidate this guarantee, to enact national legislation and conclude agreements to achieve it, However, in an effort to protect the national economy by maintaining the state's reserves of hard currency, this guarantee is bound by standards in order to create a balance between the investor's interest in transferring his money and ensuring the growth of the economy through the stability of the exchange rate and the preservation of hard currency, the most prominent of these standards are; The regulator of the free currency in financing and transfer, and that the capital invested must be from an external source, in addition to formal standards often required by the organization for the proper conduct of the process.
