| dc.description.abstract | تناولت هذه الدراسة حماية مستخدمي الصحة في ظل التغيرات الجديدة، نظرا للتزايد الكبير لظاهرة الاعتداء على هذه الفئة، هادفة إلى التعريف بهذه الفئة، وطبيعة الحماية ومظاهرها، وكنتيجة لتسجيل السلطات الجزائرية تزايد مطرد للاعتداءات على الأطقم الطبية تزامنا مع تفشي فيروس كرونا، وجاء الأمر20-01 المؤرخ في 30 جويلية 2020، الذي يعدل ويتمم الامر 66-156 المتضمن قانون العقوبات 01 لتعزيز الحماية لمستخدمي الصحة، حيث تأتي التعديلات المذكورة على ضوء ما لوحظ في الآونة الأخيرة من أن العقوبات المقررة للتعدي على الموظفين العموميين لم تعد كافية بما يلزم لتحقيق الردع بنوعيه، وأن بعض فئات الموظفين العموميين سيما العاملين بالمؤسسات الصحية باتو أكثر عرضة للتعدي عليهم بسبب أو أثناء تأدية مهامهم، الأمر الذي استدعى وضع هذا الأمر، بغية بسط حماية جنائية أنجع للمؤسسة الصحية والعاملين بها.
