| dc.description.abstract | يُعدّ التفويض الإداري أداةً قانونيةً فعّالة لتوزيع الصلاحيات وتخفيف الأعباء عن المسؤول الإداري. إلا أنه يخضع لشروطٍ وضوابط قانونية لضمان مشروعيته وفعاليته. ويستند التفويض إلى نصٍّ قانونيٍّ يُحدّد بوضوح الصلاحيات المفوَّضة، ويجب ألا يتجاوزها المفوَّض. وفي الوقت نفسه، يبقى المفوَّض مسؤولاً عن الإشراف على تنفيذ المهام المفوَّضة وضمان تحقيقها للأهداف المرجوّة. يُعدّ الإشراف جزءاً أساسياً من عملية التفويض، ويشمل سحب أو إلغاء قرار التفويض إدارياً، إلى جانب الرقابة القضائية التي تضمن مشروعية القرارات وحماية الحقوق الفردية. وبهذه الطريقة، يُحقّق التفويض توازناً دقيقاً بين توزيع الصلاحيات والمسؤوليات، مما يُسهم في تحسين سير العمل داخل الإدارة العامة، شريطة الالتزام بالأطر القانونية والتنظيمية.Administrative delegation is an effective legal tool for distributing authority and alleviating the burdens on the administrative official. However, it is subject to legal conditions and regulations to ensure its legitimacy and effectiveness. Delegation is based on a legal provision that clearly defines the delegated powers, and the delegate must not exceed these powers. Meanwhile, the delegator remains responsible for overseeing the execution of the delegated tasks and ensuring they meet the intended goals. Supervision is a fundamental part of the delegation process, involving the administrative withdrawal or cancellation of the delegation decision, along with judicial oversight that ensures the legality of decisions and the protection of individual rights. In this way, delegation achieves a delicate balance between the distribution of power and responsibility, contributing to the improvement of workflow within public administration, provided that legal and regulatory frameworks are adhered to. | |
