| dc.description.abstract | يلعب العقار دورا استراتيجيا في تحقيق دفعة قوية للنهوض باقتصاديات الدول واحداث نقلة نوعية في مجال التنمية ، لذا نجد ان الكثير منها تعمل على تهيئة جميع الإجراءات القانونية من اجل جلب الاستثمارات" داخليا وخارجيا " واستغلال هذا المجال ، الا ان هذا الأخير يتعرض لجملة من الإشكالات القانونية والتي تتمحور في عدم وجود سندات رسمية تثبت ملكية هذا العقار، والتي تسمح بعد ذلك بالقيام بكل التعاملات الاقتصادية في اطار احترام المنظومة القانونية للدولة ، وهذه الظاهرة تعرف بالبناءات الفوضوية والتي اصبحت من المسائل التي تورق الدول وتقف حجر عثرة في مجال التنمية ، لذلك حاولت الدولة الجزائرية لا يجاد اطر قانونية من اجل حل هذه المشكلة وفقا لما جاء به القانون 15/08 فهل هذا الاخير اتى بالحلول ؟ .
