dc.description.abstractتقوم سلطات الضبط الإداري بأداء المهام الموكلة إليها في سياق مسؤوليتها عن حماية النظام العا م بجميع عناصره، حيت تخضع أعمالوإجراءات الضبط الإداري فلي الظروف العادية لقيود وضوابط تسختند إلى متطلبات مبدأ المشروعية بوجه عام ، وإلى الرقابة القضائية على ماتتخذه سلطات الضبط من إجراءات وتدابير على وجه الخصوص، كما قد تطرأ بعض لظروف الإستثنائية التي تقتضي توسيع الصلاحيات المخولة لسلطاتت الضبط الإداري بما يتلاءم مع طبيعة تلك الأوضاع، حيث تجيز نظرية الظروف الإستثنائية لتلك الهيئات باستبعاد تطبيق القواعد القانونية العادية مؤقتا، وإستبدالها بإجراءات وقواعد إسلتثنائية، وذلك بما يضمن مواجهة الحالة الطارئة وتحقيق المصلحة العاملة فلي ظل إحترام الضوابط التي تفرضها المشروعية الإستثنائية.Administrative control authorities perform the tasks assigned to them within the context of their responsibility to protect the public order with all its elements, as the actions and procedures of administrative control under normal circumstances are subject to restrictions and controls based on the requirements of the principle of legality in general, and to judicial oversight of the procedures and measures taken by the control authorities in particular. Some exceptional circumstances may arise that require expanding the powers granted to administrative control authorities in a manner consistent with the nature of those situations, as the theory of exceptional circumstances allows those bodies to temporarily exclude the application of ordinary legal rules and replace them with exceptional procedures and rules, in order to ensure confronting the emergency situation and achieving the general interest while respecting the controls imposed by exceptional legality.
