| dc.description.abstract | تعتبر دعوى الدفع بعدم الدستورية في التجارب الدستورية المقارنة آلية رقابية، تتيح للمواطن المشاركة في عملية الرقابة الدستورية على القوانين عن طريق القضاء، وقد تبنتها التشريعات المختلفة وفق أساليب وإجراءات مختلفة بحسب اختلاف ظروفها السياسية والقانونية والاجتماعية، وقد سعى المشرع الجزائري منذ إقرارها بموجب التعديل الدستوري لسنة 2016 إلى محاولة تطويرها بإيجاد أدوات وإجراءات وقواعد العمل المناسبة منذ دخولها حيز التنفيذ سنة 2019، وذلك من أجل دعمها وتعزيز دورها في مجال احترام حقوق وحريات المتقاضين المكرسة دستوريا. The claim of unconstitutionality in comparative constitutional experiences is considered a control mechanism that allows the citizen to participate in the constitutional control process over laws through the judiciary.
