Abstract
تناولت هذه المذكرة بالدراسة والتحليل لموضوع الجرائم الواقعة علي الأسرة ، وذلك نظرا لأهمية الأسرة كمكون أساسي في بناء المجتمع واستقراره ،وقد تم تقسيم المذكرة إلي فصلين، بداية بالفصل الأول الذي تناولنا فيه الجرائم المرتكبة علي الزوجة ،والذي استعرضنا فيه جريمة ترك مقر الأسرة ،وجريمة الإهمال لزوجة الحامل وأيضا جريمة الزنا ،وجريمة الفاحشة بين ذوي الأرحام ،أما الفصل الثاني فتناولنا فيه الجرائم الماسة بالأبناء والتي تتمثل في جريمة الإجهاض ،وجريمة ترك الأطفال وعدم تسليم طفل تحت رعاية الغير، وأيضا الجرائم المتعلقة بالحالة المدنية، وهي جريمة انتحال اسم الغير وجريمة عدم التصريح ،وجريمة الحيلولة، كما تم التطرق إلي الأبعاد القانونية لتلك الجرائم، مع استعراض العقوبات المقررة لها، والتدابير الوقائية، التي يمكن اتخاذها لحماية الأسرة من التفكك والانهيار، ولقد خلصت الدراسة إلى أن القانون يوفر حماية مهمة للأسرة، لكن ما تزال هناك ثغرات في التطبيق والممارسة، مما يستدعي تطوير النصوص القانونية، وتكثيف جهود التوعية والردع الاجتماعي والقضائي.This memorandum presents a comprehensive legal and analytical study on crimes committed against the family, recognizing the family as a foundational unit in the structure and stability of society. The study is divided into two main chapters: Chapter One is dedicated to offenses committed against the wife, and covers: The offense of abandoning the marital residence. The offense of neglecting a pregnant spouse .The crime of adultery .The offense of committing indecent acts between close relatives (incest).Chapter Two addresses offenses against children, including :The crime of abortion .The offense of child abandonment and the failure to return a child to their lawful custodian .Offenses related to civil status, such as :The crime of identity impersonation.Failure to declare civil status. Obstructing the proper registration of civil events. The memorandum further examines the legal dimensions of these offenses, detailing the applicable sanctions as prescribed by law, and discussing the preventive measures that may be implemented to protect the family from disintegration and breakdown.The study concludes that, although current legislation provides essential protections for the family, there are still significant shortcomings in enforcement and practical implementation. This highlights the necessity of updating and refining legal provisions, while also reinforcing public awareness, legal deterrence, and judicial effectiveness
