| dc.description.abstract | إن اللجوء د جوء إلى العقوبة السالبة للحرية (عقوبة الحبس)كجزاء جنائي وما تتميز به من مساوئ قد أثبت عدم فعاليته في تحقيق إعادة الادماج الاجتماعي للمحكوم عليه؛ ولقد جعل عدم الفعالية هذا مختلف التشريعات الجنائية تتجه نحو تبني عقوبة المراقبة الاكترونية كعقوبة بديلة عن عقوبة الحبس بديلة تنفذ في وسط مفتوح . لقد أثبتت هذا النوع من العقوبات فعاليته نسبيا في الحد من مساوئ الحبس وتحقيق الغرض المعاصر للعقوبة، كما أسهم في جعل عقوبة الحبس الملاذ الاخير الذي يلجأ إليه القاضي الجزائي. وبذلك تتجه السياسة العقابية المعاصرة من جعل العقوبات البديلة األصل وعقوبة الحبس الإستثناء.
