| dc.description.abstract | تعتبر الأحكام القضائية من أهم ركائز النظام القانوني في الجزائر، حيث تساهم في تحقيق العدالة وحفظ الحقوق وتنظيم العلاقات، وتحمل هذه الأحكام حجية قانونية تجعلها ملزمة للأطراف المعنية ولا يجوز إعادة النظر فيها إلا عن طريق الطعون القضائية كالاستئناف والنقض، وتستند حجية هذه الأحكام إلى مبادئ قانونية مثل حجية الأمر المقضي والمشروعية واحترام حقوق الدفاع، وتساعد هذه الأحكام على تعزيز الاستقرار القانوني والثقة في النظام القضائي، وبالتالي تعزيز العدالة وحماية حقوق الأفراد والمجتمع.Judicial rulings are considered one of the most important pillars of the legal system in Algeria, as they contribute to achieving justice, preserving rights, and regulating relationships. These rulings carry legal authority, making them binding on the concerned parties and preventing reconsideration except through legal appeals such as appeals and cassation. The authority of these rulings is based on legal principles such as res judicata, legality, and respect for defense rights. These rulings help enhance legal stability and confidence in the judicial system, thereby promoting justice and protecting the rights of individuals and society | |
