Abstract
This study is structured around legislative and regulatory controls linked to the management and treatment of medical waste, as waste of a particular nature, which Algerian legislation has treated in differentiated ways over time according to the different control texts for each step, it aims to clarify the legal bases adopted in the field of classification of medical care waste in accordance with legal and regulatory texts, by analyzing them, and comparing them with what is set out in certain international conventions and highlighting the historical evolution experienced by the Algerian legal system in this area.
تتمحور هذه الدراسة حول الضوابط التشريعية والتنظيمية المتعلقة بتسيير ومعالجة نفايات الرعاية الصحية، بوصفها نفايات ذات طابع خاص، تعامل معها التشريع الجزائري بطرق اختلفت في مراحل زمنية باختلاف النصوص الضابطة لكل مرحلة وعليه تهدف الدراسة إلى توضيح الأسس القانونية المعتمدة في مجال تصنيف نفايات المعالجة الطبية وفقا للنصوص القانونية والتنظيمية، من خلال الوقوف عندها وتحليلها، بالاعتماد على المنهج التحليلي، ومقارنتها بما ورد في بعض الاتفاقيات الدولية معتمدين بذلك على المنهج المقارن، مع إبراز التطور التاريخي الذي مرت به المنظومة القانونية الجزائرية في هذا المجال
