| dc.description.abstract | وقد نظم المشرع المدني الجزائري المعاملات بين الأفراد، حيث بين الحالات التي تكون فيها تصرفاتهم باطلة أو قابلة للإبطال، وكذلك من له الحق في الاحتجاج بهذا البطلان، ولكنه نص أيضا على كيفية تصحيح البطلان حسب الشروط، و في حالة الحكم ببطلان التصرف بشكل عام أو العقد بشكل خاص، يتم إرجاع المتعاقدين إلى ما كان عليه قبل العقد وهذا الأصل، إلا أنه يجوز تلقيه بعض الاستثناءات سواء بين المتعاقدين أو الغير الأطراف وإنقاذ العقد يعتبر باطلا أن المشرع الجزائري أخذ بالآراء المتعلقة بتحول العقد أو بتخفيض العقد، كما بين كل منهما شروطه وآثاره.
