Abstract
The hospital plays a leading role in maintaining public health, Therefore, it was entrusted with various tasks in this field in order to take care of the health of individuals, however, this entails legal responsibility that varies between civil and administrative, the Algerian legislator worked through many texts to improve the service in general ; Especially when it comes to mistakes made by the medical and administrative staff, which sometimes lead to harming the health of the individual instead of taking care of it. And what is happening in terms of strife of responsibilities, as the citizen remains in many cases a victim of neglect, This is what drives him to resort to the courts seeking justice, here, the judge stands on the extent of the shortcomings of some legislative texts that require reconsideration and making them more appropriate and rigorous. يلعب المستشفى دورا رياديا في الحفاظ على الصّحة العمومية، ولذلك فقد أوكلت له مهام مُتنوعة في هذا النّطاق من أجل العناية بصحة الأفراد، غير أن ذلك يرتّب مسؤولية قانونية تتنوّع بين المدنية والإدارية، وعمل المشرع الجزائري من خلال العديد من النصوص على تحسين الخدمة بصفة عامة، ولاسيما عندما يتعلق الأمر بالأخطاء الصّادرة من الطاقمين الطبي والإداري والتي تؤدي أحيانا بالإضرار بصحة الفرد عِوض العناية بها، وما يحصل من تقاذف المسؤوليات، حيث يبقى المواطن في العديد من الحالات ضحية الإهمال، وهو ما يدفعه للالتجاء للقضاء طلبا لإنصافه، وهنا يقف القاضي على مدى قصور بعض النّصوص التشريعية التي تستوجب إعادة النظر فيها وجعلها أكثر ملاءمة وصرامة.
