| dc.description.abstract | وتتمتع الإدارة العامة بامتيازات السلطة العامة التي تسهل تنفيذ العقود الإدارية بكفاءة وسلاسة. وتمنح الإدارة العامة سلطة تعديل أو إنهاء العقد الإداري، مما يسمح لها بتعديل شروط العقد الإداري أو إنهائه إذا تغيرت الظروف أو تغيرت المتغيرات التي شكلت أساس العقد. وتساعد هذه السلطة الإدارة في تنظيم عمليات العقد بما يتماشى مع احتياجاتها والمصلحة العامة. وتشمل الحدود التي يجب على الإدارة الالتزام بها في تنفيذ العقود الإدارية القوانين والمبادئ العامة التي تحدد نطاق صلاحياتها في التعديل والإشراف وفرض العقوبات وإنهاء العقد الإداري. ويهدف فهم هذه الحدود إلى تحقيق توازن ناجح بين صلاحيات الإدارة وحقوق المتعاقدين، مما يضمن سير العمليات بشكل عادل وفعال في إطار العقود الإداريةThe general administration enjoys the privileges of public authority that facilitate the efficient and smooth implementation of administrative contracts. The general administration is granted the authority to amend and terminate, allowing it to modify the terms of the administrative contract or terminate it if circumstances change or variables that formed the basis of the contract alter. This authority assists the administration in regulating contract operations in line with its needs and the public interest. The boundaries that the administration must adhere to in implementing administrative contracts include laws and general principles that define the scope of its powers in modification, supervision, imposing penalties, and terminating the administrative contract.
