| dc.description.abstract | تهدف هذه الدراسة إلى إلقاء الضوء على الطعن في المادة الإدارية، إذ يعد هذا الأخير ضمانة للخصم ضد أخطاء قضاة الدرجة الأولى، إذ يتيح إعادة النظر في الأحكام الصادرة عنهم من قضاة الدرجة الثانية، وذلك بهدف إعادة النظر في النزاع من حيث الوقائع والقانون، ومن هذا المنطلق تطرح هذه الدراسة إشكالية: ما هي خصوصية الطعن في الأحكام في المادة الإدارية؟ ولمناقشتها قسمت الدراسة إلى فصلين: تناول الأول طبيعة الطعن في المادة الإدارية، أما الفصل الثاني فقد خصصناه لأحكامه العامة.This study aims to shed light on the challenge in the administrative article, as the latter is a guarantee for the opponent against the errors of first-degree judges, as it allows the review of the rulings issued by them by second-degree judges, with the aim of reviewing the dispute in terms of facts and law. From this standpoint, this study raises a problem: What is the specificity of the challenge in the administrative article? To discuss it, the study was divided into two chapters: the first dealt with the nature of the challenge in the administrative article, while we devoted the second chapter to its general provisions. | |
