| dc.description.abstract | بالرغم من إقرار المؤسس الدستوري بموجب تعديل دستور سنة 2016 لـ 50 نائبا من نواب المجلس الشعبي الوطني و 30 عضو من أعضاء مجلس الأمة الحق في إخطار المجلس الدستوري ليباشر دوره في الرقابة على دستورية المعاهدات والقوانين والتنظيمات إلا أن السؤال الذي يطرح نفسه في هذا المقام يتمثل أساسا فيما إذا كان لهذا التعديل أي اثر ايجابي في تفعيل هاته الآلية لإخطار المجلس الدستوري أم أن هناك جملة من المعوقات التي ستجعل من هاته الآلية غير مفعلة على ارض الواقع شأنها في ذلك شأن آلية إخطار المجلس الدستوري من قبل رئيسي غرفتي البرلمان المتمثلين أساسا في كل من رئيسي المجلس الشعبي الوطني و رئيس مجلس الأمة. Although the Constitutional Institution approved, pursuant to the 2016 amendment to the Constitution, 50 deputies of the National People’s Assembly and 30 members of the National Assembly the right to notify the Constitutional Council to begin its role in monitoring the constitutionality of treaties, laws, and regulations, the question that arises in this regard is essentially: Whether this amendment has any positive impact on activating this mechanism for notifying the Constitutional Council, or is there a number of obstacles that will make this mechanism inactive on the ground, like the mechanism for notifying the Constitutional Council by the presidents of the two chambers of Parliament, who are mainly represented by each of the presidents?
