Abstract
في سبيل تفعيل التصديق والتوقيع الإلكترونيين وضمان موثوقية استعمالهما قام المشرع الجزائري باستحداث آلية إدارية رقابية ضابطة هي السلطة الوطنية للتصديق الإلكتروني تتمتع باستقلالية عضوية ووظيفية، الا أنها لا تعمل بمعزل عن الأهداف الحكومية أو خارج السياسة العامة التي تسطرها الدولة وتشرف على تنفيذها، بل هي بمثابة سلطة متخصصة معاونة للحكومة تستعين بها في إنجاز مهام وأعمال دقيقة تحتاج إلى درجة كبيرة من التخصص، ومن أجل ذلك خصها المشرع بنظام قانوني خاص وسلطات تقديرية واسعة لضرورات مرونة العمل الإداري وسلاسته، وتخضع اعمال هذه السلطة للرقابة القضائية لتشكل ضمانة قوية في مواجهة احتمال تعسفها في استعمال امتيازات السلطة العامة التي تتميز بها
In order to activate electronic certification and signature and ensure the reliability of their use, the Algerian legislator has created a controlling administrative mechanism, which is the National Authority for Electronic Certification, which has membership and functional independence. However, it does not work in isolation from governmental objectives or outside the general policy that the state sets and supervises its implementation. Rather, it serves as an authority. An assistant specialist for the government who can be used to accomplish precise tasks and work that require a large degree of specialization. For this reason, the legislator has allocated her with a special legal system and broad discretionary powers for the necessities of flexibility and smoothness of administrative work. The work of this authority is subject to judicial oversight to constitute a strong guarantee against the possibility of her abuse of privileges. The public authority that characterizes it.
