| dc.description.abstract | تناولت هذه الدراسة موضوع التعويض في المسؤولية المدنية، باعتباره الوسيلة الأساسية لجبر الضرر الناتج عن الإخلال بالإلتزامات، ورغم كثرة الأبحاث حول المسؤولية بقي تقديرالتعويض موضوًعا يحتاج إلى مزيد من الإهتمام. ترّك هذه الدراسة على دور القاضي في تحديد التعويض، بما يحقق التوازن بين العدالة وحرية التعاقد، رخاصة عند تعديل الشرط الجزائي إذا كان غير متناسب مع حجم الضرر. وخلصت الدراسة إلى أن التعويض أداة فعالة لتحقيق العدالة، وأن سلطة القاضي في تقديره ضرورية لكنها مقيدة بضوابط قانونية، كما أن االتفاق المسبق على التعويض )الشرط الجزائي( يخفف من النزاعات لكنه الُيلغي رقابة القضاء.This study addresses the issue of compensation in civil liability, as it is the primary means of redressing damages resulting from a breach of obligations. Despite the abundance of research on liability, the assessment of compensation remains a topic that requires further attention. This study focuses on the role of the judge in determining compensation, achieving a balance between justice and freedom of contract, especially when amending the penalty clause if it is disproportionate to the extent of the damage. The study concludes that compensation is an effective tool for achieving justice, and that the judge's discretion is necessary but limited by legal controls. Furthermore, prior agreement on compensation (the penalty clause) mitigates disputes but does not eliminate judicial oversight. | |
