| dc.description.abstract | وتكمن أهمية صلاحيات القاضي الإداري في توجيه الأوامر إلى الإدارة في تحقيق العدالة القانونية، فبسبب الامتيازات الواسعة التي تتمتع بها الإدارة فإنها قد تتعسف في قراراتها ضد الأفراد، وعندما يتم استئناف مثل هذه القرارات وإصدار أحكام ضدهم، فإن الإدارة غالبًا ما ترفض تنفيذها، لذا تدخل المشرع وأصدر قوانين تسمح للقاضي الإداري بتوجيه الأوامر إلى الإدارة، وتوسع دوره من مجرد إلغاء القرارات إلى إعادة ترتيب شرعيتها تمامًا. إن استخدام دعاوى الإلغاء وطرق حماية الحريات العامة، وسلطة الأمر والغرامة التهديدية من قبل القاضي الإداري يساهم في ضمان تنفيذ القرارات القضائية وتحقيق مبدأ الشرعية.The importance of the powers of an administrative judge in directing orders to the administration lies in the achievement of legal justice. Due to the extensive privileges of the administration, it may arbitrariness in its decisions against individuals. When such decisions are appealed and judgments are issued against them, the administration often refuses to implement them. So, the legislator intervened and passed laws allowing the administrative judge to direct orders to the administration, expanding his role from simply canceling decisions to completely rearranging the legality. The use of cancellation lawsuits and methods of protecting public freedoms, the authority of the order and the threatening fine by the administrative judge contributes to ensuring the implementation of judicial decisions and the achievement of the principle of legality. | |
