| dc.description.abstract | لقد نشأت السلطات الإدارية المستقلة نتيجة لعجز الإدارة الكلاسيكية عن القيام ببعض المهام والجوانب الاقتصادية، وذلك بهدف ضبط وحماية الحقوق والحريات العامة للدولة. ولكي تتمكن من القيام بهذا الدور بنجاح، ضمن أطر قانونية تضمن حيادها ونزاهتها، كان لا بد من توفير ميزة وجودها لها، الأمر الذي جعلها خارج نطاق السلطة التنفيذية، وإن كانت مكملة لمهامها. ووفقا لموضوعنا، فإن الاستقلال يتعلق بجانبين؛ الجانب العضوي والوظيفي، اللذين يتبين أنهما نسبيان وليس مطلقين. independent administrative authorities, as a result of the inability of the classical administration to fulfill certain tasks and economic aspects, were created in order to control and protect the public rights and freedoms of the state. In order to fulfill this role successfully, within legal frameworks that guarantee their neutrality and impartiality, it was necessary to provide them with the advanta of their existence, which made them outside the executive authority, although complementary to its tasks. According to our topic, independence relates to two aspects; the organic and functional aspect, which prove relative rather than absolute. | |
