| dc.description.abstract | تبحث هذه الدراسة في آثار الملاحقة الجزائية على الوضع القانوني للموظفين العموميين في ظل القانون الجزائري، وذلك من خلال تحليل التفاعل بين أحكام تشريعات الوظيفة العامة ومتطلبات قانون الإجراءات الجزائية. وتُبيّن الدراسة أن هذه الآثار تنقسم إلى فئتين: تدابير مؤقتة سابقة على صدور الحكم -كالتوقيف الاحترازي- التي تؤثر على استمرار الموظف في أداء مهامه، وعقوبات نهائية تكميلية -كالعزل من الوظيفة- التي تنهي علاقة العمل بصفة دائمة. وتخلص الدراسة إلى أنه على الرغم من إقرار المشرع الجزائري لضمانات قانونية معينة في هذا الصدد، إلا أن تشتت النصوص ذات الصلة وغموضها يؤدي أحياناً إلى تباين في التطبيق؛ مما يستدعي إجراء مراجعة تشريعية شاملة تحقق التوازن المنشود بين مقتضيات الردع الجزائي وضمان استمرارية المرفق العام.This study examines the impact of criminal prosecution on the legal status of public officials under Algerian law, by analyzing the interplay between civil service legislation and the requirements of the Code of Criminal Procedure. The study identifies two categories of such impacts: provisional measures taken prior to a final judgment—such as precautionary suspension—which affect an official’s ability to continue performing their duties; and definitive, supplementary sanctions—such as dismissal from service—which permanently terminate the employment relationship. The study concludes that, although the Algerian legislator has established certain legal safeguards in this regard, the fragmentation and ambiguity of the relevant provisions occasionally lead to inconsistent application. Consequently, a comprehensive legislative review is warranted to strike the necessary balance between the requirements of criminal deterrence and the need to ensure the continuity of public services. | |
