| dc.description.abstract | تعد الرقابة على دستورية القوانين من الضمانات الهامة لاحترام القاعدة الدستورية وإنفاذها داخل الدولة، إعمالا لمبدأ سمو الدستور وتدرج القواعد القانونية، وقد أخذت المغرب بهذه الرقابة بصورتيها السياسية والقضائية، فتحولت من الرقابة القضائية التي انتهجتها بعد استقلالها للرقابة الممارسة بواسطة المجلس الدستوري بموجب المراجعة الدستورية سنة 1992، لتتحول فيما بعد للرقابة قضائية بواسطة المحكمة الدستورية في دستور سنة 2011. Control of the constitutionality of laws is one of the important guarantees of the respect of the constitutional rule and its enforcement within the state, according to the constitution supremacy and graduation of the legal rules. Morocco has taken this type of control in its both forms, political and judicial, where it has transformed from the judicial control after the independence to a control performed by the constitutional council in 1992, then to become a judicial control performed by the constitutional court in the constitution of 2011. | |
