Abstract
تهدف هذ ه الدراسة إلى معالجة موضوع الفرق بين الإرهاب وحق المقاومة المشروعة،لأنه يتم في الكثير من الأحيان الخلط العمدي بين الإرهاب من جهة وحق المقاومة المشروعة من جهة أخرى ،واعتبار حق المقاومة من الاأعمال الإرهابية ،وتأتي الدراسة لتبين متى يكون استخدام القوة عمال مشروعا ومتى يكون استخدام القوة من الأعمال الإرهابية، وبيان الأبعاد القانونية لعملية الخلط بين الظاهرتين ،لنطرح إشكال رئيسي يتمثل في :ما هي الأسباب التي تتمسك بها الدول للإمتناع عن وضع تعريف دقيق للإرهاب على المستوى الدولي وما هي األبعاد المترتبة على عملية الخلط بين الظاهرتين محل الدراسة؟وتوصلنا إلى نتائج هامة أهمها: أن حق المقاومة حق للشعوب تؤكده جميع الشرائع والمعاهدات الدولية وأن لا علاقة له بالإرهاب،وان عملية الخلط بينها وبين الإرهاب يقف عائقا أمام التعاون الدولي في سبيل مكافحة الإرهاب This study aims to address the issue of the difference between terrorism and the right to legitimate resistance, because in many cases there is intentional confusion between terrorism on the one hand and the right to legitimate resistance on the other hand, and the right to resistance is considered a terrorist act. The study comes to show when the use of force is a legitimate act and when The use of force is considered a terrorist act, and to clarify the legal dimensions of the process of mixing the two phenomena, let us pose a main problem, which is: What are the reasons that countries cling to for refraining from setting an accurate definition of terrorism at the international level, and what are the dimensions resulting from the process of mixing the two phenomena under study? And we have arrived at this conclusion. To important results, the most important of which are: that the right to resistance is a right of peoples affirmed by all international laws and treaties and that it has no relation to terrorism, and that the process of confusing it with terrorism stands as an obstacle to international cooperation in the fight against terrorism.

Committed to combating terrorism and extremism in all its forms and manifestations and eliminating its goals and causes that target people’s lives and property, and the belief of Islamic countries that terrorism and extremism constitute a serious violation of human rights, especially the right to life and the right to freedom and security, as well as an obstacle to the work of state institutions and obstructs social and economic development, and destabilizes the security and stability of states.
