Abstract
إن المراجعة القضائية للشرعية الداخلية للقرارات الإدارية هي عملية يتم من خلالها فحص مدى توافق القرارات الإدارية مع القوانين والمعايير القانونية المعمول بها. وتهدف هذه المراجعة إلى ضمان أن تكون تصرفات الهيئات الإدارية متوافقة مع القانون، وتحمي حقوق الأفراد وتدعم مبدأ سيادة القانون. وتشمل الشرعية الداخلية للقرار الإداري جوانب مختلفة مثل الاختصاص والشكل والسبب والموضوع والغرض. ومن خلال المراجعة القضائية، يمكن للمحاكم أن تتدخل لإلغاء أو تعديل أو تعليق تنفيذ القرارات الإدارية غير القانونية، وبالتالي تعزيز الشفافية والمساءلة في الإدارة العامة.Judicial review of the internal legality of administrative decisions is a
process through which the conformity of administrative decisions with
applicable laws and legal standards is examined. This review aims to
ensure that the actions of administrative bodies are in accordance
with the law, protecting individuals' rights and upholding the principle
of the rule of law. The internal legality of an administrative decision
encompasses various aspects such as competence, form, reason,
subject matter, and purpose. Through judicial review, courts can
intervene to annul, modify, or suspend the implementation of unlawful
administrative decisions, thereby enhancing transparency and
accountability in public administration.
