| dc.description.abstract | تتناول هذه الدراسة الحماية القانونية من الجرائم المرتبطة بالذكاء الاصطناعي في ظل التطور المتسارع للتقنيات الرقمية وظهور جرائم مستحدثة، مثل التزييف العميق والاحتيال السيبراني والهجمات الإلكترونية. وتهدف الدراسة إلى توضيح مفهوم جرائم الذكاء الاصطناعي، وتحليل المسؤولية الجنائية المترتبة عليها، وتقييم مدى كفاية التشريعات الجزائرية في التصدي لمثل هذه الجرائم. وتخلص الدراسة إلى أن التشريع الجزائري يوفر حماية قانونية عامة، إلا أنها تظل غير كافية نظراً لغياب تشريعات متخصصة بشأن جرائم الذكاء الاصطناعي، فضلاً عن الصعوبات المتعلقة بالتكييف القانوني والأدلة الرقمية؛ مما يستلزم استحداث إطار قانوني عصري يتلاءم مع التطورات التكنولوجية.This study examines legal protection against artificial intelligence-related crimes amidst the rapid evolution of digital technologies and the emergence of novel offenses, such as deepfakes, cyber fraud, and cyberattacks. It aims to define AI-related crimes, analyze the associated criminal liability, and assess the adequacy of Algerian legislation in addressing such offenses. The study concludes that while Algerian legislation provides general legal protection, it remains insufficient due to the absence of specialized laws targeting AI-related crimes, as well as challenges regarding legal classification and digital evidence. Consequently, there is a need to establish a modern legal framework that keeps pace with technological advancements. | |
