Abstract
على خطى القانون الجنائي الداخلي يقدم المقال مقاربة لمبدأ التناسب في القضاء الجنائي الدولي لاعتباره من مرتكزات السياسة الجنائية الدولية الحديثة ويحقق التوازن بين حق المجتمع الدولي في العقاب وحق الجاني في محاكمة عادلة
Following in the footsteps of domestic criminal law, this article considers an approach to the principle of proportionality in international criminal justice as a foundation of modern international criminal policy and which achieves a balance between the right of the international community to punishment and the right of the guilty party. to a fair process. And as international judicial institutions are specialized in the examination of the most serious crimes on human rights, it is their duty to issue rigorous judgments that go with the seriousness of these acts and it is in this point that the legislators of the fundamental statute of the permanent international criminal court were a little lenient.
