| dc.description.abstract | تتناول هذه الدراسة دور المحكمة الدستورية في حماية الحقوق والحريات باعتبارها آلية دستورية لضمان سمو الدستور وصون الحقوق الأساسية للأفراد. وقد تم التركيز على الإطار المفاهيمي للحقوق والحريات، والتنظيم الدستوري لها، إضافة إلى إبراز مكانة الكتلة الدستورية كمرجعية في الرقابة الدستورية. كما عالجت الدراسة اختصاصات المحكمة الدستورية وآليات تدخلها في الرقابة على دستورية القوانين وتفسير النصوص الدستورية وتسوية النزاعات بين السلطات. وتوصلت الدراسة إلى أن المحكمة الدستورية تمثل ضمانة حقيقية لتعزيز دولة القانون وحماية الحقوق والحريات من أي انتهاك تشريعي أو مؤسساتي، من خلال تكريس مبادئ الشرعية الدستورية وحماية التوازن بين السلطات.This study examines the role of the Constitutional Court in protecting rights and freedoms as a constitutional mechanism aimed at ensuring the supremacy of the Constitution and safeguarding fundamental rights. The research focuses on the conceptual framework of rights and freedoms, their constitutional regulation, and the importance of the constitutional bloc as a reference in constitutional review. It also analyzes the powers of the Constitutional Court and its role in reviewing the constitutionality of laws, interpreting constitutional provisions, and resolving disputes between public authorities. The study concludes that the Constitutional Court constitutes an effective guarantee for strengthening the rule of law and protecting rights and freedoms against legislative or institutional violations through the enforcement of constitutional legitimacy and the preservation of the balance of powers. | |
