| dc.description.abstract | القانون رقم 22-13، المعدل والمتمم لقانون الإجراءات المدنية والإدارية، وذلك امتثالاً للأحكام الدستورية الواردة في التعديل الدستوري لسنة 2020، حيث سعى المشرع الجزائري إلى مراجعة الأحكام المتعلقة بالقضاء الإداري لمعالجة النقائص التي طالما عانت منها من حيث البنية والاختصاص، وخاصة تلك المتعلقة بإنشاء درجة ثانية من التقاضي تكريساً لمبدأ التقاضي على درجتين وتخفيفاً للأعباء الملقاة على مجلس الدولة. ولإدخال تعديلات محددة على المنظومة التشريعية المتعلقة بتوزيع الاختصاص في المسائل الإدارية، تم استكمال القانون رقم 22-13 بأحكام تتعلق بتنظيم اختصاص المحاكم الإدارية، وتحديد اختصاص المحاكم الإدارية بالاستئناف، وكذلك مراجعة اختصاصات مجلس الدولة وتحديد دوره كهيئة نقض لتوحيد التفسير القضائي في المسائل الإدارية، بالإضافة إلى اختصاصه الاستشاري. Law No 22-13, amending and supplementing the Civil and Administrative Procedure Code, in order to comply with the constitutional provisions contained in the constitutional amendment of 2020, where the Algerian legislator attempted to review the provisions related to administrative justice to remedy the deficiencies that have long affected it in terms of structure and jurisdiction, especially those related to the creation of a second degree of litigation as a dedication to the principle of litigation in two levels and to alleviate the burden placed on the Council of State. To include specific amendments to the legislative system related to the distribution of jurisdiction in administrative matters, Law No 22-13 was completed with provisions concerning the regulation of the jurisdiction of administrative courts, determining the jurisdiction of administrative courts for appeals, as well as reviewing the competences of the Council of State and establishing its role as a cassation body to unify judicial interpretation in administrative matters, in addition to its advisory jurisdiction. | |
