| dc.description.abstract | تبنت مختلف التشريعات الجنائية أنظمة مستحدثة بديلة عن العقوبة السالبة للحرية من بينها نظام الوضع تحت المراقبة الإلكترونية كآلية مستحدثة للتفريد العقابي، الذي ظهر كنتيجة عن السلبيات التي أفرزها الحبس قصير المدة، والغاية من هذا النظام هو تفادي سلبياتها وما انجر عنها من مساوئ سواء على المستوى الاقتصادي للدولة والمحكوم عليه من الجانب الاجتماعي والنفسي خاصة، وهو ما جعل السياسة العقابية تتجه إلى أنظمة حديثة من شأنها أن تحقق الغرض الذي تسعى إليه ألا وهو الإصلاح والتأهيل من جهة وتقليص معدل الجريمة من جهة أخرى ، وهو النظام الذي تبناه المشرع الجزائري في تعديله الأخير لقانون تنظيم السجون وإعادة الإدماج الاجتماعي للمحبوسين قانون 18/01 المؤرخ في :30 جانفي 2018 كآلية مستحدثة للتفريد العقابي. Various criminal legislations have adopted new systems as an alternative to the punishment of deprivation of liberty, including the system of being placed under electronic surveillance as a new mechanism for punitive isolation, which emerged as a result of the negatives produced by short-term imprisonment, and the purpose of this system is to avoid its negatives and the resulting disadvantages, both on the economic level. The state and the convict from the social and psychological aspects in particular, which made the penal policy turn to modern systems that would achieve the purpose it seeks, which is reform and rehabilitation on the one hand and reducing the crime rate on the other hand.
