| dc.description.abstract | لقد تحول تركيز السياسة العقابية الحديثة من معاقبة الجريمة إلى مراعاتها باستخدام الوسائل المفيدة، في إطار إصلاح النظام الجزائي، لتصحيح سلوك مرتكب الجريمة. السلوك وكذلك من خلال معالجة الحوافز الكامنة وراءه. وهكذا اعتمد المشرع الجزائري أجهزة حديثة متخصصة تمكن النظام الجزائي من القيام بمهامه. ويهدف ذلك إلى تحقيق إعادة اندماج مرتكب الجريمة في المجتمع؛ على سبيل المثال، استخدام العلامات الإلكترونية. وقد تم تطوير هذا الأخير من قبل المشرع الجزائري بموجب القانون رقم 18/01 المؤرخ في 30 يناير 2018 ووفقا للقانون رقم 05/04 المتعلق بتنظيم السجون وإعادة الإدماج الاجتماعي للمسجونين. تهدف الدراسة الحالية إلى تسليط الضوء على استخدام العلامات الإلكترونية، وبيان فاعليته في إعادة إدماج السجناء. The focus of modern punitive policy has shifted from penalizing the criminal offence to heeding it by using useful means, within the framework of reforming the penal system, to correct the perpetrator’s behaviour as well as by addressing its underlying incentives. Thus, the Algerian legislature has adopted a specialized modern devices that would enable the penal system to carry out its tasks. This aims at achieving the perpetrator’s reintegration into society; for instance, the use of electronic tagging. The latter has been developed by the Algerian legislature by Act No. 18/01 of January, 30th, 2018 and in accordance with the Act No. 05/04 on the organization of prisons and the social reintegration of prisoners The current study aims at highlighting the use of electronic tagging, and indicating its effectiveness in the reintegration of the prisoners. | |
