| dc.description.abstract | لقد اعتنى المرسوم التنفيذي رقم 18/199 المتعلق بتفويض المرفق العام للجماعات الإقليمية بموضوع الرقابة الإدارية، بحيث خصص لها فصلا كاملا اشتمل على مختلف أنواع الرقابات من رقابة داخلية، خارجية، قبلية أو بعدية كانت. ونظرا لأهمية هذه الرقابة في الحفاظ على المال العام وضمان المنافسة في الوصول إلى أحسن العروض من جهة واتساع هذه الرقابة وشمولها لجميع أنواع التفويضات، حاولنا من خلال هذه الدراسة التطرق إلى الرقابة الإدارية الداخلية التي تمارسها لجنة اختيار وانتقاء العروض،و الرقابة الإدارية الخارجية عن طرق لجنة تفويضات المرفق العام والرقابة البعدية عن طريق السلطة المفوضة . يهدف هذا الموضوع إلى دراسة الأحكام القانونية المتعلقة بالرقابة الإدارية ، والبحث في مدى فعاليتها في تكريس مبدأ الشفافية في إبرام اتفاقية التفويض من جهة،ومبدأ الجماعية في اختيار أحسن العروض من جهة ثانية،وضمان منافسة مشروعة تكفل المساواة بين المترشحين من جهة ثالثة ، مما يبعد في النهاية اتفاقية التفويض عن كل شبهة . الكلمات المفتاحية: الرقابة الإدارية،تفويض المرفق العام ،الجماعات الإقليمية . The importance of this control in maintaining public money and ensuring competition in reaching the best offers on the one hand, and the expansion of this control for all types of delegations, we have addressed internal management control exercised by the selection and selection Committee, and external administrative control through the General Facility delegations Committee and the follow-up control through the delegated authority.
